Terms of Service

By using MaterialSales (the “Platform”) you agree to these terms. If you don’t agree, don’t use it.

1. What we are

MaterialSales is an Australian-owned online marketplace that connects suppliers of bulk materials (sand, gravel, concrete, soil, turf, agricultural inputs etc.) with buyers. We are a listing platform — we don’t buy, sell, deliver, store, broker, certify or warrant the materials offered by suppliers. Every transaction happens directly between buyer and supplier.

The Platform is operated by Chevron Sands Pty Ltd (ACN 615 508 337, ABN 19 615 508 337), registered office 51 Barron Street, Hendon QLD 4362, Australia (“we”, “us”, “our”). For formal notices, write to that address or to hello@materialsales.com.au.

2. Accounts

• You must be 18+ and have authority to act on behalf of any business you list under.
• You’re responsible for keeping your account secure. Don’t share passwords.
• Provide accurate information. Material misrepresentation may result in account suspension or removal.
• You can delete your account any time from dashboard settings.

3. Subscription fees (suppliers)

• Suppliers pay a recurring monthly subscription to publish listings. Tier prices are displayed at /subscribe and on /sell.
• We never charge commission, transaction fees, or markup on supplier prices.
• Three monthly tiers cap the number of active (live or pending) listings: Basic ($42/mo, 1), Pro ($83/mo, 3), Enterprise ($155/mo, 5). All prices ex-GST.
• An optional 12-month upfront plan ($1,499 ex-GST, 5 active listings, FEATURED badge) is available for suppliers who prefer a one-off payment with no auto-renewal. This is priced below 12 × the Enterprise monthly tier so it’s cheaper for suppliers committing for the full year.
• Monthly subscriptions auto-renew on the same calendar day each month. Cards are charged the moment a subscription is created and on each renewal.
• Subscription prices are subject to change with at least 30 days’ notice — existing active subscriptions keep their original price until next renewal.

4. Cancellation, no refunds

Suppliers can cancel any time from the dashboard’s Billing tab. Cancellation takes effect immediately — the subscription ends, all of the supplier’s listings are removed straight away, and the account resets to no active subscription. The supplier can subscribe again at any time to start fresh.Past billing periods are non-refundable, and the current period is not pro-rated on cancellation. If a listing is rejected by moderation, it is removed but the subscription fee for the current period is not refunded (the supplier may submit replacement listings within the active subscription).

4a. Failed payments

If a renewal charge fails (declined card, insufficient funds, etc.) the subscription is marked past_due and the supplier’s listings are temporarily paused. We’ll email the supplier and our payment processor will automatically retry the charge. Listings reactivate automatically once a successful charge clears.

5. What you can’t list

• Anything illegal under Australian law
• Hazardous or restricted materials without proper certification
• Materials you don’t actually have rights to sell
• Misleading prices, descriptions, or photos
• Duplicate listings (one product = one listing)
• Listings outside Australia

6. Buyer enquiries

Buyers can submit enquiries with or without a free account. Suppliers are responsible for replying directly. We don’t mediate disputes, verify quotes, or guarantee delivery.

7. Supplier ratings + reviews

Buyers can rate suppliers after a transaction. We may remove reviews that violate our guidelines (defamation, off-topic, fake) but we don’t edit them or remove genuine negative feedback.

8. Disputes between buyer + supplier

Disputes are between you and the other party. We’ll provide relevant transaction records on request and may refer parties to the ACCC, Fair Trading, or other appropriate bodies. We are not a party to any contract for the sale of materials.

9. Our liability

To the maximum extent permitted by law, MaterialSales is not liable for any direct or indirect loss, damage, or expense arising from your use of the Platform, including but not limited to:

• Quality, fitness, safety, or compliance of any material listed
• Supplier or buyer conduct
• Delivery, payment, or contractual disputes
• Platform downtime or data loss

Nothing in these terms excludes any consumer guarantee under the Australian Consumer Law that cannot be excluded by contract.

10. Suspension + termination

We may suspend or close any account that breaches these terms, engages in fraud, or harms platform safety. We’ll give reasons by email and a path to appeal where possible.

11. Changes

We may update these terms. Material changes will be emailed to account holders at least 14 days in advance.

12. Governing law

These terms are governed by the laws of Victoria, Australia. Any disputes that can’t be resolved by good-faith negotiation will be heard in the courts of Victoria.
