Terms of Service

By using MaterialSales (the “Platform”) you agree to these terms. If you don’t agree, don’t use it.

1. What we are

MaterialSales is an Australian-owned online marketplace that connects suppliers of bulk materials (sand, gravel, concrete, soil, turf, agricultural inputs etc.) with buyers. We are a listing platform — we don’t buy, sell, deliver, store, broker, certify or warrant the materials offered by suppliers. Every transaction happens directly between buyer and supplier.

2. Accounts

  • You must be 18+ and have authority to act on behalf of any business you list under.
  • You’re responsible for keeping your account secure. Don’t share passwords.
  • Provide accurate information. Material misrepresentation may result in account suspension or removal.
  • You can delete your account any time from dashboard settings.

3. Listing fees (suppliers)

  • Suppliers pay a flat listing fee to publish a listing. Fees are displayed at checkout and on the /sell page.
  • We never charge commission, transaction fees, or markup on supplier prices.
  • Listings are paid up-front for a fixed term (6, 12, or 24 months).
  • The Ultimate Supplier Bundle gives 5 × 24-month FEATURED listing slots, used at any time within the 24-month window.
  • Plan prices are subject to change with at least 30 days’ notice — already-purchased listings keep their original price.

4. Rejection refund guarantee

Every submitted listing is reviewed by a human within 1 hour. If we reject it for any reason, you’re refunded automatically (less a small admin fee per the rate published on /sell at the time of purchase). The reason will be sent by email so you can fix and resubmit.

5. What you can’t list

  • Anything illegal under Australian law
  • Hazardous or restricted materials without proper certification
  • Materials you don’t actually have rights to sell
  • Misleading prices, descriptions, or photos
  • Duplicate listings (one product = one listing)
  • Listings outside Australia

6. Buyer enquiries

Buyers can submit enquiries with or without a free account. Suppliers are responsible for replying directly. We don’t mediate disputes, verify quotes, or guarantee delivery.

7. Supplier ratings + reviews

Buyers can rate suppliers after a transaction. We may remove reviews that violate our guidelines (defamation, off-topic, fake) but we don’t edit them or remove genuine negative feedback.

8. Disputes between buyer + supplier

Disputes are between you and the other party. We’ll provide relevant transaction records on request and may refer parties to the ACCC, Fair Trading, or other appropriate bodies. We are not a party to any contract for the sale of materials.

9. Our liability

To the maximum extent permitted by law, MaterialSales is not liable for any direct or indirect loss, damage, or expense arising from your use of the Platform, including but not limited to:

  • Quality, fitness, safety, or compliance of any material listed
  • Supplier or buyer conduct
  • Delivery, payment, or contractual disputes
  • Platform downtime or data loss

Nothing in these terms excludes any consumer guarantee under the Australian Consumer Law that cannot be excluded by contract.

10. Suspension + termination

We may suspend or close any account that breaches these terms, engages in fraud, or harms platform safety. We’ll give reasons by email and a path to appeal where possible.

11. Changes

We may update these terms. Material changes will be emailed to account holders at least 14 days in advance.

12. Governing law

These terms are governed by the laws of Victoria, Australia. Any disputes that can’t be resolved by good-faith negotiation will be heard in the courts of Victoria.
